(1) These terms apply to all orders you place in our online store ElevStep. Your contract partner is:
Glowy Zone
Owner: Vincent Thron
Hollandweg 9
25421 Pinneberg
Germany
Phone: +49 179 4400036
Email: elevstep.official@gmail.com
(2) Our store is intended exclusively for consumers, meaning individuals who buy for purposes that are not mainly related to their trade, business or profession.
(3) We sell to customers in the United States, the United Kingdom and Canada.
2. How the contract is formed
(1) The products shown in our store are not a legally binding offer but an invitation to place an order.
(2) How to order: choose a product and the variant you want (for example height and size) and add it to your cart. From the cart you go to checkout, where you enter your contact and delivery details and choose a payment method. Before you place the order, you see all details again and can correct input errors directly in the fields or with your browser's back button. By clicking the button that completes the order with an obligation to pay, you make a binding offer to buy the goods in your cart.
(3) Immediately after placing your order you receive an order confirmation by email. With this order confirmation we accept your offer, and the contract is concluded.
(4) The contract language is English.
(5) We store the contract text. You receive your order details in the order confirmation email. You can view and print these terms on this page at any time. If you have a customer account, you can also see your orders there.
3. Prices, taxes and shipping costs
(1) All prices are final prices and are charged in the currency shown at checkout. If this is not your card's currency, your bank may charge conversion fees.
(2) As a small business within the meaning of Section 19 of the German VAT Act (UStG), we do not charge German VAT.
(3) Shipping is free.
(4) Depending on your country, import duties, taxes (for example VAT, GST/HST or sales tax) and carrier handling fees may be charged on delivery. They are not included in our prices and are payable by you.
4. Delivery
(1) We deliver to the United States, the United Kingdom and Canada.
(2) Delivery takes approximately 5 to 12 business days (Monday to Friday, excluding public holidays), starting on the day after the contract is concluded.
(3) If we cannot ship your order within this time, we will tell you without delay. You can then cancel the order and receive a full refund.
(4) If we ship parts of an order separately, this costs you nothing extra.
5. Payment
(1) You can pay by credit or debit card (Visa, Mastercard, Maestro, American Express, UnionPay), Apple Pay, Google Pay, Shop Pay or, where available, Klarna. The payment methods offered for your order are shown at checkout; they depend on your country and your device, among other things.
(2) Payment is due when the contract is concluded. Card, Apple Pay, Google Pay and Shop Pay payments are charged when you place the order. If you pay with Klarna, Klarna's payment terms shown at checkout also apply.
6. Retention of title
The goods remain our property until they have been paid for in full.
7. Right of withdrawal
You have a 14-day right of withdrawal. The details are set out in our Right of Withdrawal. You bear the direct cost of returning the goods. We do not offer a voluntary return policy beyond this right.
8. Warranty
(1) The statutory warranty rights apply.
(2) If goods arrive with obvious transport damage, please report it to the carrier as soon as possible and let us know. This does not affect your statutory rights; it only helps us make claims against the carrier.
9. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
(2) For slightly negligent breaches of an essential contractual obligation, our liability is limited to the damage that is typical for the contract and foreseeable. Essential obligations are those whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely.
(3) Otherwise, liability for slight negligence is excluded. This does not affect any mandatory consumer protection laws of your country.
10. Dispute resolution
We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
11. Governing law and final provisions
(1) These terms and the contracts concluded under them are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law does not deprive you of the protection of mandatory consumer protection laws of the country in which you habitually reside.
(2) If individual provisions of these terms are invalid, the rest of the contract remains valid.
